Jenifer Salzberg is a commercial litigator with over 25 years of experience in state and federal courts, as well as in domestic and international arbitrations. She also represents clients in investigations conducted by regulatory authorities.
Jen’s practice focuses on complex commercial litigation, including business and contract disputes. She represents public and private companies and their management in litigation involving a wide range of corporate governance, securities, and competition issues, including claims involving partnership disputes, breach of contract, fiduciary duty, and fraud. She also regularly serves as appellate counsel after adverse rulings from trial courts, and has a track record of winning reversals of unfavorable court decisions.
Jen began her legal career at Cravath, Swaine & Moore.
Representative Matters:
• Represented a large bank in the Commercial Division of New York state Supreme Court for breach of a Distribution Agreement.
• Represented a real estate trust and several of its agents in an AAA arbitration concerning claims brought by investors of a landmark New York City building.
• Represented a multinational bank in a series of arbitrations around the country brought by former employees arising out of the bank’s exit from a line of domestic business.
• Won full reversals of unfavorable rulings from the First Department and the New York Court of Appeals.
• Represented the demand committee of a publicly traded company’s Board of Directors in connection with a shareholder demand involving an alleged malpractice in a patent litigation.
• Successfully represented a private company on a motion to compel arbitration and stay litigation against it in state court.
• Successfully represented a senior executive of a public company during an SEC investigation.
• Advised a telecommunications equipment manufacturer concerning a multi-million dollar dispute with a supplier.
• Represented a leading real estate firm in litigation concerning partnership rights.
• Represented significant witnesses in a wide-ranging insider-trading investigation.
• Successfully represented a leading private equity firm in litigation concerning an international investment.
