David S. Pegno, a founding member of the firm, has a wide range of experience in commercial litigation in state and federal courts, as well as domestic and international arbitration. Dave represents clients in matters involving federal securities laws, commercial contracts, partnership disputes, breach of fiduciary duty and fraud claims, and directors’ and officers’ liability, among many other areas.

Dave has deep experience in the financial sector, representing banks, hedge funds, broker dealers and securities firms in litigation, as well as in AAA, JAMS and FINRA proceedings. He handles disputes related to securities, letters of credit, derivatives and mortgage-backed securities, credit agreements, employment, deferred compensation, and internal and claims investigations. He also has a strong track record in real estate litigation, including disputes related to commercial leases, construction, and financing agreements. Dave also has considerable experience in bankruptcy court litigation.

Dave has extensive experience in insurance law and litigation. He pursues insurance fraud and other claims for affirmative relief on behalf of insurance companies and represents insureds in negotiating complex coverages, such as D&O and E&O insurance and other specialty coverages. He advises insureds concerning potential insurance claims and litigates and arbitrates insurance coverage matters for policyholders.

Dave is recommended in New York Super Lawyers for Business Litigation. The National Law Journal recognized Dave as an Elite Boutique Trailblazer. Before co-founding DPK, Dave practiced at Kaye Scholer LLP and Kornstein Veisz Wexler & Pollard LLP and clerked for the Honorable Louis L. Stanton in the Southern District of New York. 

 

Representative matters:
 
•    Represented a real estate trust and several of its agents in an AAA arbitration concerning claims brought by investors of a landmark New York City building.
•    Represented a multinational bank in a series of arbitrations around the country brought by former employees arising out of the bank’s exit from a line of domestic business.
•    Represented a public company in multiple putative class actions and arbitrations asserting claims under consumer protection laws. 
•    Represented an offshore trust in an International Center for Dispute Resolution arbitration arising out of a SPAC transaction. 
•    Represented a manufacturing company as co-defense counsel in a breach of contract case tried before a jury in the Southern District of New York resulting in a full defense verdict. 
•    Represented a Fortune 50 company seeking coverage under policies providing $500 million of insurance, securing one the of the largest recoveries for a corporate policyholder on record.
•    Represented defendants in multiple class actions arising out of a multi-billion dollar IPO.
•    Defended an energy company in letter of credit litigation seeking an eight-figure damage award in a bankruptcy proceeding.
•    Represented individuals in the United States and Europe in a series of litigations arising out of a foreign bank’s loan for the purchase and construction of a hotel in Manhattan.
•    Represented a leading professional athlete in litigation arising from financial dispute with his former advisors and lenders.
•    Defended a financial institution on claims brought by its landlord in connection with the termination of its net lease to a Manhattan office building.
•    Successfully defended a federal securities class action seeking damages for violation of the proxy rules, resulting in a defense verdict at trial.
•    Pursued claims on behalf of a hedge fund for breach of a financing agreement by a national financial institution.
